1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

According to religious pluralism, the profound differences among the chief objects of adoration in the great religious traditions are largely due to the different ways in which a single transcendent reality is experienced and conceived in human life. The most prominent developer and defender of religious pluralism in the twentieth century is John Hick. Hick uses the expression ‘the Real’ to designate the transcendent reality ‘authentically experienced’ as the different gods and impersonal absolutes worshipped in the major religious traditions. A (...) central claim Hick makes is that, apart from some purely formal characteristics, the Real is ineffable in that the intrinsic properties making up its nature are beyond the scope of any human concepts. I explore this central claim and argue that it implies the dubious, if not incoherent, view that the Real in itself has neither one of many pairs of contradictory properties. (shrink)

Isaac Newton's Scientific Method examines Newton's argument for universal gravity and his application of it to resolve the problem of deciding between geocentric and heliocentric world systems by measuring masses of the sun and planets. William L. Harper suggests that Newton's inferences from phenomena realize an ideal of empirical success that is richer than prediction. Any theory that can achieve this rich sort of empirical success must not only be able to predict the phenomena it purports to explain, but (...) also have those phenomena accurately measure the parameters which explain them. Harper explores the ways in which Newton's method aims to turn theoretical questions into ones which can be answered empirically by measurement from phenomena, and to establish that propositions inferred from phenomena are provisionally accepted as guides to further research. This methodology, guided by its rich ideal of empirical success, supports a conception of scientific progress that does not require construing it as progress toward Laplace's ideal limit of a final theory of everything, and is not threatened by the classic argument against convergent realism. Newton's method endorses the radical theoretical transformation from his theory to Einstein's. Harper argues that it is strikingly realized in the development and application of testing frameworks for relativistic theories of gravity, and very much at work in cosmology today. (shrink)

This work brings together eight linked essays which make the case for a revival of general jurisprudence in response to the challenges of globalisation, explores how far the heritage of Anglo-American jurisprudence and comparative law is adequate to meeting the challenges, and puts forward an agenda for general jurisprudence and comparative law, especially in the English-speaking world in the first ten or twenty years of the millennium. The book is traditional in focussing on the mainstream of Anglo-American intellectual heritage and (...) moderately radical in identifying the need for rethinking basic issues and putting forward a series of provocative propositions as a basis for discussion. The legal requirements and justifications for collecting patient-identifiable data without patient consent were examined. The impetus for this arose from legal and ethical issues raised during the development of a population-based disease register. Numerous commentaries and case studies have been discussing the impact of the Data Protection Act 1998 and Caldicott principles of good practice on the uses of personal data. But uncertainty still remains about the legal requirements for processing patient-identifiable data without patient consent for research purposes. This is (...) largely owing to ignorance, or misunderstandings of the implications of the common law duty of confidentiality and section 60 of the Health and Social Care Act 2001. The common law duty of confidentiality states that patient-identifiable data should not be provided to third parties, regardless of compliance with the DPA1998. It is an obligation derived from case law, and is open to interpretation. Compliance with section 60 ensures that collection of patient-identifiable data without patient consent is lawful despite the duty of confidentiality. Fears regarding the duty of confidentiality have resulted in a common misconception that section 60 must be complied with. Although this is not the case, section 60 support does provide the most secure basis in law for collecting such data. Using our own experience in developing a disease register as a backdrop, this article will clarify the procedures, risks and potential costs of applying for section 60 support. (shrink)

According to the Westminster Confession, “God from all eternity did... freely and unchangeably ordain whatsoever comes to pass. Yet... thereby neither is God the author of sin or is violence offered to the will of the creatures.” It is hard to see how these two points can be consistently maintained. Hugh McCann, however, argues that by placing God’s decisions outside of time, both propositions are perfectly consistent. I agree with McCann that God’s determining decisions do not make him the author (...) of our sins. But I think that God’s determining decisions, whether temporal or outside of time, preclude our possessing the libertarian free will that McCann’s believes we do possess. In fact, so I argue, if we possess libertarian free will, then elevating God’s determining decisions outside of time only results in God’s eternal decisions being within our power to determine. According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

A number of theologians and philosophers have found theodical value in the theme of divine solidarity with human suffering. To further develop this theme, I examine what it would mean to assert that Christ on the cross participated in a representative sample of human suffering. Particular attention is paid to Christ’s cry of dereliction. I argue that if God through Christ identified with the very worst kinds of human suffering on the cross, then the cry of dereliction should be interpreted (...) as indicating an epistemic break between God and Christ, and not merely an attentional disruption. According to this account, Christ’s death cry expressed his temporary inability to grasp the significance of his passion and death. In this way, Christ on the cross suffered the full effects of divine hiddenness, thus sharing with horror-sufferers the experience of meaning-negating suffering. (shrink)

Peter Kosso discusses the weak gravitational lensing observations of the Bullet Cluster and argues that dark matter can be detected in this system solely through the equivalence principle without the need to specify a full theory of gravity. This paper argues that Kosso gets some of the details wrong in his analysis of the implications of the Bullet Cluster observations for the Dark Matter Double Bind and the possibility of constructing robust tests of theories of gravity at galactic and greater (...) scales. Even the Bullet Cluster evidence is not sufficiently detailed to allow precision tests of General Relativity that would distinguish it from its rivals at galactic and greater scales. Taking into account the total evidence available, we cannot rule out “ugly” solutions to the dynamical discrepancy in astrophysics that involve both a large quantity of dark matter and a theory of gravity whose predictions differ significantly from those of General Relativity for interactions taking place at galactic and greater scales. This paper takes aim at contemporary conceptions of liberal democracy and the accompanying loss of faith with liberal democratic theory which may be observed. There exist problems with procedure, outcomes, and the decline of universality in the face of liberal nationalism which only serve to reinforce boundaries. The clearest cases of these problems have arisen in the United States over the past few years, and especially since the events of September 11, 2001.
